1. Acceptance of Terms

By downloading, installing, or using PonPon ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. The App is operated by Marumaru, LLC ("we," "us," or "our").

2. Description of Service

PonPon is an AI-powered application that allows users to apply creative effects to photos and videos. The App utilizes artificial intelligence technology to process and transform user-submitted content.

3. User Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you must have parental or guardian consent to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

4. User Content and Face Data

You retain all ownership rights to the content you submit to the App. By submitting content, you grant us a limited, non-exclusive, royalty-free license to process your content solely for the purpose of providing the App's services.

You represent and warrant that:

  • You own or have the necessary rights to the content you submit
  • Your content does not infringe any third-party intellectual property rights
  • Your content does not violate any applicable laws or regulations
  • Your content does not contain illegal, harmful, or objectionable material
  • When you select photos for AI video generation, the App uses on-device face detection to help you identify and crop face regions. Face detection coordinates are processed entirely on your device and are never transmitted or stored
  • Cropped face images are uploaded to our servers solely for the purpose of generating your requested video content
  • By uploading photos containing faces, you confirm that you have obtained any necessary consent from the individuals depicted

5. Prohibited Uses

You agree not to use the App to:

  • Create deepfakes or manipulated media intended to deceive or harm others
  • Generate content that depicts minors in any inappropriate context
  • Create non-consensual intimate imagery of real individuals
  • Produce content that promotes violence, discrimination, or illegal activities
  • Infringe on the intellectual property rights of others
  • Attempt to reverse engineer, decompile, or extract source code from the App
  • Circumvent any security measures or access controls

6. AI-Generated Content

The App uses artificial intelligence to generate effects and transformations. AI outputs may occasionally produce unexpected or imperfect results. We do not guarantee the accuracy, quality, or suitability of AI-generated content for any particular purpose. You are solely responsible for reviewing and using AI-generated content appropriately.

7. Purchases and Subscriptions

Certain features of the App may require payment. All purchases are processed through the Apple App Store or Google Play Store and are subject to their respective terms and refund policies. Subscription fees are billed in advance on a recurring basis. You may cancel your subscription at any time through your device's account settings.

8. Intellectual Property

The App, including its design, features, code, and content (excluding user-submitted content), is owned by Marumaru, LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARUMARU, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Marumaru, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Delaware.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms in the App or through other reasonable means. Your continued use of the App after such modifications constitutes acceptance of the revised Terms.
